PRIVACY POLICY

 

Section 1: Preamble

Proesis is particularly committed to respecting privacy and protecting PERSONAL DATA . Proesis undertakes to implement adequate measures to ensure the protection, confidentiality and security of the PERSONAL DATA of any person from whom data is collected, in accordance with legal requirements, in particular European Regulation 2016/ 679 on the protection of personal data ("GDPR") and the national laws applicable in the European Union. The purpose of this DATA PROTECTION POLICY is to inform you of the commitments made by Proesis to ensure that your PERSONAL DATA is respected.

 

Section 2: Scope

This DATA PROTECTION POLICY applies to all processing of PERSONAL DATA, implemented by Proesis, as DATA CONTROLLER, and by its SUBCONTRACTORS, within the European Union, relating to persons (hereinafter "you") including customers, prospects, partners, recruitment candidates, users of our software and services, suppliers, service providers, Internet users.

 

Section 3: Definitions

“PERSONAL DATA”: any data allowing the direct or indirect identification of a natural person.
“DATA PROCESSING”: operations carried out on PERSONAL DATA, in particular the collection, recording, use, transmission or communication.
“PROCESSING RESPONSIBLE”: legal entity in charge of determining the purposes of the processing and the means implemented.
“SUBCONTRACTOR”: legal entity that processes PERSONAL DATA on behalf of the DATA CONTROLLER.

 

Section 4: Data collected

Proesis ensures that it collects and processes PERSONAL DATA that is relevant, adequate, non-excessive and strictly necessary to achieve the purposes that have been determined beforehand. Proesis takes all necessary steps to ensure that your data is accurate, complete and, if necessary, updated. Proesis undertakes to inform the persons concerned of the processing of their data.

We thus process the PERSONAL DATA concerning you that you are likely to communicate to us, in particular during the following operations:

• When you sign a contract with Proesis (software and/or services);

• When you register for one of our training courses;

• When you browse our sites;

• When you download resources (documents, files, etc.) from our website;

• When you provide products or services to us;

• When you participate in events organized by Proesis;

• When you meet Proesis during professional meetings or professional events;

• When you consent to receive our newsletters and other commercial information from us;

• When you wish to apply for a job offer with us;

• When you want to get in touch with us to ask us questions, request information, etc.

In this context, Proesis may in particular collect and process the following PERSONAL DATA:

• Your identity: first name, surname, title, position;

• Your contact details: postal address, email, telephone number;

• Your identifiers (in case of creation of an account within the framework of a contract): login, number of MUTS Services (Maintenance, Update, Training and Support Services);

• Your payment and transaction information: bank details, credit card data, transaction details;

• Your application information: CV, cover letter, photo;

• Your technical and browsing information on our sites (please see section 8 below relating to cookies);

• Any other information that you provide to us directly and voluntarily in connection with the use of our sites, services and contracts that we may have entered into with you. The mandatory nature of the information you must provide is generally indicated at the time of data collection on the corresponding forms by an asterisk. Proesis may offer you to provide certain PERSONAL DATA for prospecting, communication and marketing purposes. You can explicitly and freely consent or not to the collection and processing of your PERSONAL DATA for these purposes. You agree that the PERSONAL DATA concerning you communicated to Proesis is up-to-date, exact, complete and unequivocal.

 

Section 5: Purposes of collection

Proesis undertakes to collect and process your PERSONAL DATA in a fair and lawful manner. The processing implemented by Proesis responds to explicit, legitimate and determined purposes. Your data may in particular be processed for the following purposes:

• To enable you to subscribe to/access our software or services (management of commercial proposals); In this context, the legal basis of the processing is the execution of the contract between Proesis and you.

• To manage your subscription and your use of our services; In this context, the legal basis of the processing is the execution of the contract between Proesis and you.

• To process your transactions and payments; In this context, the legal basis of the processing is the execution of the contract between Proesis and you when it comes to managing your transactions and payments.

• To manage the contractual relationship with our customers, service providers, suppliers and partners (contract management, orders, deliveries, invoices, etc.); In this context, the legal basis of the processing is the execution of the contract between Proesis and you.

• To send you marketing information about us; In this context, processing is based on the legitimate interest of Proesis, more specifically its economic interest in communicating personalized offers to you, better understanding your needs and offering you adapted services.

• To analyze your browsing on our websites and improve their use (please see section 8 below on cookies); In this context, the legal basis for the processing is the legitimate interest of Proesis, more specifically its economic interest in constantly improving its websites and services and in understanding your needs to meet your expectations when you browse a website of Proesis.

• To respond to your questions and complaints; In this context, the legal basis for processing is either the performance of the contract if the request is linked to the contractual relationship between Proesis and you, or the legitimate interest of Proesis, more specifically its economic interest in communicating clearly with you and understand your needs and expectations.

• To track your application file submitted online on one of our websites or sent by post. In this context, the legal basis for the processing is the legitimate interest of Proesis, more specifically its interest in responding to your requests for applications and in finding suitable profiles for the positions available within Proesis.

 

Section 6: Non-transmission of collected data

Proesis undertakes not to transmit your PERSONAL DATA to third party companies or partners.

 

Section 7: Data Retention

Proesis retains your PERSONAL DATA for as long as necessary to achieve the purposes for which it was collected and processed. Proesis may, however, keep your PERSONAL DATA for a longer period to comply with legal obligations and in particular applicable limitation periods. In order to define an adequate data retention period, Proesis uses the following criteria in particular:

• Data relating to your subscription/your contract, your payments and the use of our services are kept for the duration of the subscription/contractual relationship and then in accordance with the applicable limitation periods;

• Data relating to the management of the commercial relationship with our service providers and partners are kept for the duration of the contractual relationship and then in accordance with the applicable limitation periods;

• When your data is used for the purpose of commercial prospecting, Proesis retains your PERSONAL DATA until you express your wish to no longer receive communications, otherwise in accordance with the duration defined by the applicable legislation;

• When your data is collected in the context of requests/questions relating to IT services and products, Proesis retains your PERSONAL DATA until you express your wish to no longer receive communications;

• Applicants' files may be kept for up to 2 years from the last contact with the said applicants, unless they consent to a longer retention period; in this case, the data is archived in accordance with the applicable limitation periods.

 

Section 8: Cookies

Proesis websites use cookies to improve your experience and optimize our websites and services. A cookie is a small text file transferred from a web server to your web browser or hard drive when you visit a website. A cookie allows your computer to store various technical data allowing statistics related to visits to our websites to be made. If your web browser is configured to accept cookies, they will be stored in the web browser or hard drive until the expiration date has passed or until you delete the cookies yourself.

Section 9: Security

Proesis ensures the security of your PERSONAL DATA by implementing data protection through the use of physical and logical security means.

 

Section 10: Data transfer

Proesis may communicate your PERSONAL DATA.

Proesis will then require the recipient to take, in accordance with the regulations in force, all organizational and technical measures to ensure an adequate level of protection of your PERSONAL DATA.

 

Section 11: Rights of data subjects

In accordance with the applicable legislation on the protection of PERSONAL DATA, you have a number of rights concerning the collection and processing of your PERSONAL DATA, namely:

• The right to be informed: you have the right to be informed in a concise, transparent, understandable and easily accessible manner of how your PERSONAL DATA is processed.

• The right of access: you have the right to obtain (i) confirmation that PERSONAL DATA concerning you are or are not being processed and, when they are, to obtain (ii) access to said data and a copy thereof.

• The right of rectification: you have the right to obtain the rectification of PERSONAL DATA concerning you which are inaccurate. You also have the right to have incomplete PERSONAL DATA completed, including by providing an additional statement.

• The right to erasure: in certain cases, you have the right to obtain the erasure of your PERSONAL DATA. However, this right is not an absolute right and Proesis may have legal or legitimate reasons to retain said data.

• The right to portability: you have the right to receive the PERSONAL DATA concerning you that you have provided to Proesis, in a structured, commonly used and machine-readable format, and you have the right to transmit this data to a another DATA CONTROLLER without Proesis obstructing it. This right only applies when the processing of your PERSONAL DATA is based on your consent or on the performance of a contract and when said processing is carried out using automated processes.

• The right to object: you have the right to object at any time, for reasons relating to your particular situation, to the PROCESSING OF PERSONAL DATA concerning you when said DATA PROCESSING is based on the legitimate interest of Proesis. Proesis may, however, invoke legitimate and compelling reasons requiring the continuation of DATA PROCESSING. When your PERSONAL DATA is processed for prospecting purposes, you have the right to oppose the processing of this data at any time. In particular, you can benefit from this right by clicking on the “unsubscribe” link available at the bottom of the messages received.

• The right to lodge a complaint with a supervisory authority: you have the right to contact a supervisory authority (such as the CNIL in France) in order to lodge a complaint concerning the practices relating to the protection of DATA A PERSONAL CHARACTER of Proesis.

• The right to transmit instructions concerning the use of data after death (this right is applicable in France): you have the right to give Proesis instructions concerning the use of your PERSONAL DATA after your death. Section 12: Modification of the Policy

Proesis may update this DATA PROTECTION POLICY at any time to adapt it to possible new practices and service offers. In this case, the date of update of the DATA PROTECTION POLICY will be updated and will indicate the day on which the modifications were made. It is your responsibility to check for any updates to this DATA PROTECTION POLICY published on the Proesis websites.

 

Section 13: Links to Third-Party Sites

While browsing our websites, you are likely to see content that includes links to third-party applications and websites. Proesis cannot control cookies or other functions used by third-party applications and websites. The processing of PERSONAL DATA implemented by these applications and sites is not governed by this DATA PROTECTION POLICY. Therefore, it is your responsibility to contact and/or directly consult the applications and websites of these third parties to obtain additional information concerning their procedures for the protection of PERSONAL DATA.
